I. INTRODUCTION

This information refers to the processing of personal data of users of the Internet server available at the following website (URL): https://oktagonmma.com/gdpr/ (the “Website”) and mobile applications (the “Mobile Apps”). The website and the Mobile Apps are operated by the Company. The term “User” refers to an individual user, and “Users” refer to multiple users.

III. DATA COLLECTED

  1. We collect and process your personal data while interacting with you (e.g. the information you provide to us when you complete a registration form on our Website or Mobile Apps or communicate with us electronically or otherwise). This includes the information you provide to us when you register as a user of our Website or Mobile Apps, place orders, report complaints about our services problems with our Website or Mobile Apps. The information may comprise your name, address, e-mail, and phone number.

  2. We do not collect or process your sensitive personal data, such as information about your health, sexuality, race, or ethnicity, unless: (i) such sensitive personal data is related to the specific purpose for which we process the data; (ii) it is required by law; and/or; (iii) a special express consent to do so is granted by you.

  3. If you voluntarily provide us with personal data, including sensitive personal data, which you provided to us at your own will and not at our request, we will delete it from our systems unless we find the processing of the data necessary for legitimate reasons.

Cookies are processed by Google Analytics, which is provided by Google Ireland Limited, a company incorporated and operated under the laws of Ireland, registration number: 368047 / Tax ID: IE6388047V. Cookies are subsequently processed by Google Ireland Limited in accordance with the privacy policy available at  https://policies.google.com/privacy?hl=cs#nosharing.

We may also receive your personal data from affiliated companies with which we are part of the same group (the “Affiliated Companies”) or from third parties, such as our business partners, subcontractors of technical, payment, and delivery services, advertising networks, analytics providers, and search information providers. If you voluntarily choose to register through an external social media platform, we may receive your personal data from those platforms when you visit our Website or Mobile Apps and register.

 

IV. TRANSFER OF PERSONAL DATA TO THIRD PARTIES AND OUTSIDE OF THE EU

  1. Your personal data is accessible by our employees and associates. They are bound by confidentiality to protect your data and trained in data security.

  2. For certain processing operations that we cannot provide on our own, we use the services and applications of processors who specialize in that processing and comply with the relevant legislation. These are providers of the following platforms and services: 

    1. Hosting and server service providers;

    2. Analytical tools: Google Analytics, Meta Pixel, TikTok Pixel, cncenter.cz;

    3. Website administrator, programmer: ZWIZU, spol. s r. o., Krásnohorská 3121/2, 851 07 Bratislava – metropolitan district of Petržalka, Company ID: 50143662, Slovak Republic;

  3. We may decide to use other applications or processors in the future to facilitate and improve personal data processing. However, we promise you that we will always demand at least the same level of security and quality of processing from the processor we use, as we do from ourselves.

  4. We only process personal data in the European Union (the “EU”) and European Economic Area (the “EEA”) countries or in countries that have been approved by the European Commission for providing a level of data protection equivalent to that within the EU. 

  5. We aim not to transfer your personal data outside the EU unless sufficient protection is provided by one of the following measures: (i) a decision made by the European Commission on adequate data protection in the recipient country or countries; (ii) appropriate binding internal rules; (iii) an approved code of ethics along with binding and enforceable obligations of the controller or processor in the non-EU and non-EEA country; (iv) an approved certification mechanism along with a binding and enforceable obligation of the controller or processor in the non-EU and non-EEA country to implement appropriate protective measures; or (v) standard contractual clauses in accordance with EU standards approved by the European Commission.

 V. DATA PROCESSING

  1. We are authorised to process your personal data where it is necessary for the performance of our mutual contract, where it is necessary to comply with our legal requirements (for example, accounting, auditing, and equal opportunities regulations), where it is necessary to pursue our legitimate interests (or the legitimate interests of a third party) unless they prevail over your fundamental rights, where it is necessary to protect your vital interests (or the vital interests of someone else) and/or where the public interest or official purposes require it.

We process your personal data for various technical, administrative, and operational purposes, including but not limited to presenting the content of our Website in the most efficient manner for you and your computer, improving our Website and its functionality, administering our contractual relationship, internal processes including troubleshooting, data analysis, testing, research, statistics, and surveys, promotional purposes including targeted marketing, providing you with relevant content, and ensuring the security of our Website.

  3. In some cases, we will only process your personal data with your explicit consent which we will specifically ask for when you provide us with your personal data. As for the use of cookies (except necessary cookies), you can grant your consent in the pop-up window that appears when you first visit our Website, or by clicking on the “Manage privacy settings” link at Manage privacy settings.   4. Providing personal data is mandatory where we require it to comply with legal or contractual obligations. Without such data, we would not be able to administer our contractual relationship or fulfil our imposed duties. In cases where we request your consent for processing your personal data, you provide your personal data voluntarily and without being obliged to do so.

  5. In addition, we may process your personal data, such as identification, contact details, and home address, for the purpose of exercising our rights and claims against you in any future litigation. We process such data on the basis of our legitimate interest to assert our rights.

For the purposes of providing services (both paid and unpaid), and making payments under the relevant contracts (including, where applicable, subscribing to our services), we will process your personal data, such as identification, contact and bank details, depending on the type of service. The processing is based on the performance of a contract to which the Website users are a party, particularly registered Website users and registered users subscribed to our services, or on the basis of a duty imposed on us by law.

  7. We may collect and process your personal data in connection with your use of our Website, Mobile Apps, and related services:

    1. when you register on our Website or Mobile Apps and provide us with your personal data in this context;

    2. when you communicate with us in any other way, for example, by e-mail or social media regarding your use of the Website or Mobile Apps.

    1. We may also process your personal data to provide you with relevant information about goods and services;

    2. If you are a registered user of the Website or Mobile Apps and have not previously unsubscribed from our newsletter, we will contact you via e-mail with information about goods and services similar to those you have previously purchased or negotiated with us to purchase, including goods and services from the Company's Affiliates and business partners;

    3. If you are not a registered user of the Website or Mobile Apps, we will only contact you electronically with your prior permission;

  10. If you are a registered User and have not previously unsubscribed from commercial messages, we may send you commercial communications electronically or contact you with information about goods and services similar to those you have previously purchased or negotiated with us to purchase, under Section 7(3) of Act No. 480/2004 Sb., on Certain Information Society Services. If you have granted your express consent to us, we may also send you commercial messages related to other services and goods provided by the Company, including those unrelated to goods and services similar to those you have previously purchased or negotiated with us to purchase, as well as offers from our Affiliates and business partners electronically. 

  11. We will not share your personal data with third parties for marketing purposes without your prior express consent.

VI. Your Rights

  1. If you want to know whether we process your personal data, you may request confirmation from us. You may also request a copy of your personal data and/or have it corrected if there are any errors. Under certain circumstances, you may request that we delete your personal data or, transfer some of your personal data to you or to other entities based on the right of transferability. 

  2. You have the right to object to certain types of personal data processing (such as direct marketing). If we have requested your consent to process your personal data, you can withdraw it without any negative consequences for you. You also have the right to object to our processing of your personal data if we have a legitimate interest in doing so (as explained above). In addition, you have the right to request that we restrict the processing of your personal data under certain circumstances.

  3. Please note that your aforementioned rights may be limited in certain situations and are subject to applicable data protection laws and regulations. For example, your right to object to the processing of your personal data may be limited if we are able to demonstrate compelling legitimate grounds for processing your personal data that prevail over your interests. To respond to your request, you will need to prove your identity and provide us with additional personal data. We will not charge you any fee for responding to your request unless permitted by law. If we do charge a fee, it will be a reasonable amount based on the scope of your request.

We will do our best to answer any questions you may have about how we process your personal data. However, you also have the right to lodge a complaint with the relevant data protection authorities. VII. PERIOD OF DATA RETENTION AND ITS SECURITY

We intend to retain your personal data for only as long as it is necessary and not beyond the purpose for which it was collected and/or as required by applicable law, including compliance with the statutory minimum retention period, and/or as it is necessary to exercise our legitimate rights (and the legitimate rights of third parties). We review the extent of the personal data processed on a regular basis and delete it when the purpose of processing has been achieved without any further reason for processing. We will retain your personal data for as long as you remain a registered user of the Website or have downloaded the Mobile App, or for as long as required by applicable law. If you need to contact customer support, we will process your data only for the duration of the request.

  2. If we process your personal data based on your consent, we will do so for the duration of your consent. You may withdraw your consent in whole or in part at any time before the expiry of the consent period. In such case, we will cease to process the personal data in respect of which the consent has been withdrawn for the specified purposes, subject to any legal obligation to process such personal data and/or use for the purposes of exercising our legitimate rights (and the legitimate rights of third parties).

  4. We store your personal data on our servers and on third-party servers, including external cloud storage services. To protect your personal data and prevent unauthorised access, we have implemented appropriate technical and organisational measures. We have also entered into contracts with external hosting providers to ensure the proper organisational and technical security of personal data. Moreover, any payment transactions made through our Website will be encrypted (for example, using TLS protocol). However, you are responsible for keeping your access details that allow you to access certain parts of our Website, such as passwords, confidential.

 

Please note that sending personal data over the internet is not entirely secure. Despite our best efforts to protect your personal information, any transmission of your data through our website is done at your own risk. However, once we receive your personal data, we will take all necessary precautions to prevent unauthorized access by following strict processes and using security features.
